    ​ PYA to attend Improving Yacht Crew Retention Conference in Nice, France To All news 30 January 2024 The PYA will be attending the 2024 Improving Yacht Crew Retention Conference in Nice, France on March 7th. This year's 3rd annual conference will bring together a panel of experts from the industry to discuss crew welfare and retention issues. The speakers will also share their insights on a wide range of topics related to the industry's current recruitment landscape. Among some of the guest speakers include representatives from IAMI, UKSA, Hill Robinson, Wilson Halligan, PG Legal, Northrop & Johnson SYM, Bluewater, the WMU and Impact Crew to name but a few.   • Know your EU Social Security Rights and Obligations

    ​ Know your EU Social Security Rights and Obligations To All news 1 March 2022 Within the EU, Seafarers, like other EU Nationals are entitled to social protection. Those crew (who are EU nationals) working on board vessels flying the flag of an EU country, by virtue of Article 11.4 of EU Regulation 883/2004, shall be subject to be insured in the Flag State. The only exception for crew to be insured in the Member State where the employer has their business/registered office, is if he/she has their residency in the same Member State. It is important to know that, although there are various private schemes offered to yachts that, along with insurance policies, claim to provide private alternatives to a state social security scheme, none of these private solutions are approved by country bodies, such as ENIM in France. There are also significant legal consequences, both civil and criminal for yachts not complying with social security obligations. France In July 2017, France introduced a social security decree, following mandatory obligations under the MLC, requiring all seafarers resident in France, or those who spend more than 181 days in France, to pay into their social security system. The aim of these regulations is to ensure seafarers resident in France are afforded protection (whether the yacht is a pleasure or commercial vessel). During the 2021 Cannes Yachting Festival, PYA Partner, Breaking The Mould Accounting, heard from local lawyers that there are still yacht owners regularly being prosecuted for hidden employment, despite the legislation being in place for 5 years. Malta With exception to the above ruling, yacht crew working on vessels registered in Malta have the benefit of registering their social security in another EU member state scheme, allowing greater flexibility to those who reside elsewhere and still receive the same social protection.     ​ MCA allows Dyslexic Seafarers extra Exam Time To All news 16 June 2022 The MCA is committed to supporting candidates with dyslexia and promoting inclusivity by m aking reasonable adjustments for candidates with dyslexia so that they are not disadvantaged. Candidates with dyslexia are now offered a minimum of 15 minutes extra per hour. This can be extended even further on a case-by-case basis if recommended by experts following an assessment of the candidate. To be eligible for the extra time, the candidate needs to present their Diagnostic Assessment Report to their college or training provider. This report needs to be from either an Educational Psychologist registered with the Health Care Practitioner Council (HCPC) or a specialist teacher with a current assessment practicing certificate. If you think you have dyslexia but are unsure, there are tools on the British Dyslexia Association website to help you do a self-assessment, however, you will need to get a formal diagnosis before you can access extra exam time. This year’s Sea Changes Forum at the Monaco Yacht Show brought together stakeholders from across the yachting industry to discuss important issues from crew welfare to the mapping of the seas. Our conference was held at the IHO HQ in Monaco, with a packed auditorium of guests who had travelled from around the world to participate in the PYA’s annual event. This year was a particularly special occasion to highlight some of the emerging technologies that will be changing our industry in the coming years ahead. We also gained insights into how yachts are being equipped to map the ocean floors, advancing our knowledge of the world’s marine ecosystem - further cementing how yachting is playing a key role in scientific discovery.     ​ South African Crew – Beware of this False Papers Scam To All news 5 October 2021 The PYA has recently learned that a Cape Town-based crew agent has been providing job seekers, for a substantial fee, with a clutch of documents that purport to show the holder is employed as a crew member onboard a yacht called S/Y ‘Malcolm Miller' (which is actually a UK-based Sail Training vessel). Due to the COVID-19 travel regulations, this documentation is issued to allow the job seeker to enter the EU and look for a real yacht-based job. A member of the PYA's confidential Member Assistance Service (MAS) has said, "Crew who try to use these false papers are risking not just their hard-earned cash but also legal problems. We know of one South African seafarer who was detained on arrival in France and deported. And, on top of this, there is the possibility that this person could be black-listed in the EU's passport control system."
