​ Cayman Islands Flag Makes Waves: New Law Protects Yacht Crew To All news 14 March 2024 The Cayman Islands, a popular registry for luxury yachts, has taken a big step towards crew welfare with a brand new law. The Cayman Islands Ship Registry (CISR) now requires written contracts for all crew members on Cayman-flagged yachts, including private vessels . This is a major first in the yachting industry and sets a strong example for better working conditions at sea. What Changed? Many crew members, especially on smaller yachts, don't have formal employment contracts. This can lead to confusion and disagreements about pay, work hours, and other important aspects of their jobs. Now, with a written contract in place, everyone is on the same page. The contract clearly outlines the crew member's rights and responsibilities, along with the yacht owner's obligations. This helps to ensure fair treatment and a more professional work environment for all. What This Means for Yacht Owners and Crew If you own a Cayman-flagged yacht, you'll need to have a written contract for each crew member. The CISR will be checking for compliance during surveys, and failing to provide a contract could be considered a violation of maritime law. For crew members, this new regulation is a positive development. It guarantees a clear understanding of their employment terms and provides essential protections. ​ Accident report - MYs Minx and Vision, near Cannes To All news 28 January 2021 Accident Investigation Report 1/2021 On 25 May 2019 at 8:52pm, the Gibraltar registered motor yacht Vision collided with the UK registered motor yacht Minx, which was anchored near Île Sainte-Marguerite, near Cannes, France. Minx’s crewman was on the foredeck and there was nothing he could have done to prevent being fatally struck by Vision’s bow. The accident happened because Vision’s skipper underestimated the risk associated with attempting a fast, close pass by the anchored Minx, a manoeuvre intended to provide an opportunity for the guests to wave goodbye, as the charterer had asked. Vision’s skipper had also consumed cannabis, which is likely to have impaired his judgement. Following the accident, an investigation was conducted by the UK Marine Accident Investigation Branch (MAIB) as a means to ascertain the cause and to prevent future accidents. Safety issues uncovered in the investigation: It is vital for the safe operation of a commercial motor yacht, that the skipper prioritised the safety of the crew, passengers and the vessel Vision’s surface-drive propulsion system was complex to operate and there were insufficient margins for error in the skipper’s plan to allow for any misjudgement, loss of control or failure. The use of recreational drugs, even in a ‘tolerant’ individual can impair decision-making and responses, which are vital for the safe operation of vessels. The accident took place in an anchorage with a 5-knot speed limit applicable to all vessels; however, Vision was proceeding at over six times that limit. Speed limits exist for a reason and it was unsafe to proceed at high speed in the anchorage. Recommendation A safety recommendation (2021/101) has been made to the Royal Yachting Association and the Professional Yachting Association to promulgate the safety lessons from this accident to owners and operators of commercial motor yachts. Geio Tischler European Commission continues to recognise Filipino seafarer certificates in maritime sector To All news 23 August 2023 The European Commission recently made the decision to maintain its recognition of seafarer certificates issued by the Philippines, a prominent global supplier of maritime labour. The decision was a testament to the Philippines' commitment to adhering to international standards within the maritime industry. Back in December 2021, the European Commission had raised concerns over the training and certification procedures within the Philippines' seafarer system which put into doubt the future of seafarer certificates. It had signaled that the recognition of these certificates might be revoked unless tangible measures were taken to align with the International Convention on Standards of Training, Certification, and Watchkeeping for Seafarers (STCW) - which could have impacted a significant number of yacht crew internationally. Since then, the Philippines has undertaken substantial initiatives to meet the stringent requirements outlined by the Commission. Notably, improvements were focused on critical aspects such as the oversight, monitoring, supervision, training, and assessment processes. There are currently an estimated 50,000 Filipino masters and officers actively serving on EU-flagged vessels. In the following months, the Commission is expected to provide additional technical support to further bolster the Philippines' education, training, and certification system for seafarers. This commitment aligns with discussions held between President Ursula von der Leyen and President of the Philippines Ferdinand Marcos on the sidelines of the EU-ASEAN summit last December. The European Commission's decision stands as a pivotal moment in sustaining the flow of skilled maritime professionals from the Philippines into the European and global shipping industry. It underscores the importance of maintaining rigorous standards and collaborative partnerships to ensure the safety, efficiency, and quality of maritime operations worldwide. ​ Safeguarding crew reputation in the age of social media To All news 28 March 2021 On the morning of February 24th, Captain Simon Johnson was lining up M/Y Go in preparation for the 10.30am bridge in St. Maarten. If you’re in the yachting industry, you’ve probably been hiding under the proverbial rock if you don’t know the rest of the story. Despite the onboard computer systems telling him all was in normal working order, the yacht’s gearbox seized into ahead. His split-second decision to make a controlled impact with the St. Maarten Yacht Club wooden dock averted a far worse disaster with the busy road bridge. Within 20 minutes, video footage of the event had been uploaded to social media and the judgement began to flow. “Asleep at the helm,” said one. “You wouldn’t let this guy Loose in charge of a row boat (sic),” said another on one post which has been viewed 128,000 times. Fortunately, no one was physically hurt in the incident, but in spreading a story before the facts had been established, the reputation Simon had built up in yachting (and Captain roles onboard M/Y Lady Lau and M/Y St David among others in a career spanning 40 years) threatened to collapse unless he retook control of the story. “To be annihilated like that in the industry was extraordinary,” says Simon. “With the Owner’s support, I put a statement on my Facebook page within 12 hours so we could take control of the narrative” he explains. “I explained that this was not an issue of incompetence, but of a major malfunction.” The next day an article in a local newspaper, The Daily Herald, was published after Simon was interviewed by one of its journalists. By presenting the truth, Simon was able to take the scandal out of the story. He also ensured that, when the news was picked up by global media outlets, (as superyacht incidents inevitably do), the facts ran alongside the footage. A high-profile figure in the industry, Simon says his reputation was established enough to ride out the crisis, although he acknowledges, nearly a month on, that he still feels stung “But if it were a 30-year-old Captain in their first command role, they may struggle to come back from this,” he explains. Aware of the link between social media and reputation (he explains he has previously engaged an independent audit of his social media presence), Simon was obviously savvy enough to understand the steps he needed to take, but not everyone in his situation would. Rodney A. Hatch – PYA Director of Deck Training Rod hails from Southampton. His connection to the sea goes back to early memories of the city skyline being dominated by the last generation of the great trans-Atlantic liners, and when the only yachts on the River Hamble were wooden ones, sympathetic neighbours of one of the last wooden hulks from the Royal Navy's Napoleonic wars. After graduating from Sheffield University, and prior to actually running away to sea, he was a Lecturer in Economics and Liberal Studies at South Bank Polytechnic, London. His yachting career and commercial sea time span over fifty years, and he is still active as a Relief Captain. From its shores to its inland hills, Rod embraces the Mediterranean littoral, with special affection for the ancient magic of the Greek islands, the glories of Renaissance Italy, France for the historic ties with England, and every vineyard along the way. Mr John Everett Nyberg, Technical Director of the International Hydrographic Organization (IHO) Has over 25 years of experience working with government and public sector stakeholders to facilitate international cooperation initiatives that ensure the safety, efficiency, and sustainability of marine transportation. Throughout his tenure at the National Oceanic & Atmospheric Administration (NOAA), John has managed international, interagency, and legislative engagements and developed high-performing teams of 100+ employees to produce and distribute thousands of nautical charting products. He was also instrumental in orchestrating transition from a raster product, paper-chart organization to one leading with the electronic navigational chart (ENC) as signature product and increasing production rates during the COVID-19 pandemic. In 2023 John was elected to a 6-year term as a member of the IHO Directing Committee. Mr Ajit Jacob, Chief Examiner for the Maritime and Coastguard Agency Ajit is the Chief Examiner for MCA and has been in the role since 2018. He joined the Maritime and Coastguard Agency in 2013, after spending 17 years in the Merchant Navy. During his career at sea, he served as Officer on Aframax Tankers and VLCC’s and as Chief Officer and Master on Ro-Pax Ferries. He joined MCA as Examiner of Mates and Masters with the Seafarer Training Branch. Thereafter, he joined the Marine Office as a Surveyor, carrying out Surveys, Audits, and Port State Control Inspections on a broad range of vessels. In his current role as Chief Examiner, Ajit is actively involved in the Seafarer training modernisation programme being coordinated by the MCA. Ajit has a Masters in International Commercial Law, is an Associate Fellow of the Nautical Institute, Member of the Institute of Chartered Shipbrokers and Younger Brother of the Trinity House. Mr Richard Falk, Director of Training and Qualifications for the Royal Yachting Association Born in Australia, Richard spent much of his childhood in, on or under the water. He continued with his passion for the sea as he moved into adulthood before finally giving up a successful corporate management career 24 years ago to turn his passion for the sea into a career, becoming a commercial master for both sail and power vessels under 200 gt. He went on to work in various parts of the world and has skippered many of the major international yacht races, including around-the-world events. For the last 12 years, he has had responsibility for the management of the RYA’s Training schemes and publications business globally as the Director of Training and Qualifications. Richard works closely with government, both in the UK and abroad, as well as with other boating governing bodies making sure their qualifications are as widely recognised abroad as possible. Mr John Wyborn, Co-founder and Director of Bluewater A yacht brokerage, charter and management company and a provider of crew training and placement services to a large proportion of the yacht crew population. He is President of MYBA (the worldwide yachting association), is on the board of the Professional Yachting Association (PYA) and is a board member of the International Association of Maritime Institutions (IAMI). He is Chairman of IAMI’s influential Small Ship subgroup. John also sits on the board of both the Merchant Navy Training Board and the Maritime Skills Alliance. He joined the Royal Navy as a seaman officer after university and served on various types of vessels including frigates, destroyers, and finally in command of HMS Mentor; a navigation and seamanship training vessel teaching RN trainees and foreign navies. Miss Angela Wallace, PYA Director of Interior Training and Head of the PYA Welfare Group An online VLE training course for Pursers onboard Super Yachts. The Purser program is fully accredited under IAMI & GUEST, and Angie was instrumental in helping create the learning objectives and outcomes for this as well as serving on IAMI GUEST Hospitality Workgroups. Mr Jo Assael, Yachts Commercial Director of the Marshall Islands Yacht Register (International Registries Inc.) Jo Assael joined the London office of IRI in 2023 as Yachts Commercial Director. Prior to joining IRI, Mr. Assael spent more than five years in yacht management at Döhle Yachts transitioning from Technical Director to Commercial Director responsible for managing the company’s growth. From 2013-2018 Jo worked for the Cayman Islands Shipping Registry as their Yacht Code Specialist and was heavily involved in drafting the Red Ensign Group’s Yacht Code while also conducting newbuild and in-service yacht surveys, inspections, and audits. He previously served as a surveyor for the United Kingdom’s (UK’s) Maritime and Coastguard Agency (MCA) and served as a lead technical specialist representing the UK MCA at the International Maritime Organization (IMO). Before his time at the UK MCA, Mr Assael was a large yacht naval architect, working on projects ranging in size from 60 to 120m. Mr. Assael serves as Chairman of the Technical Committee of the International Superyacht Society. He is a Chartered Engineer (CENG) with the Engineering Council and a member of the Royal Institute of Naval Architects (RINA). Mr. Assael has a degree in Naval Architecture from Solent University.
