​ Is the ISPS Code still suitable for yacht crew safety? To All news 27 December 2023 PYA Board Director Captain Rod Hatch writes this opinion piece regarding the ISPS Code’s current relevance in relation to the safety of yacht crew. Safety Management Systems developed with reference to the ISPS Code are not up to the task of providing yacht crew with protection from threats of increasingly aggressive tactics by environmental activists. This applies to potential physical harm which could result from attempting to confront or deter activist actions, and also to potential legal jeopardy arising from physical contact with activists. The PYA was recently contacted about this issue by The Nautical Institute (NI) and CHIRP (Confidential Human Factors Incident Reporting Programme). The NI focus is on marina security. This is reasonably well covered in marinas which are ISPS compliant, but only from landward attacks, as emphasized in the Onboard Online article. CHIRP sees a change in public perception across the maritime luxury sector, including cruise ships. They advocate sector-wide security protocols to address the risks which are not covered by the ISPS Code (such as from environmentalist activism). They also asked if there is any relevant form of ISPS Code ready for implementation, which there is not. Anecdotally, one security company contacted about this issue reported that when the subject of such activism crops up during Shipboard Security Officer training, then in general crew attitudes are that activists should be met hands-on, which in fact would produce a disastrous outcome. There is a serious gap in crew preparedness which needs to be plugged here. It appears that captains have no clear directives regarding how they and their crew should respond, both during an incident and then during its negative PR aftermath. The NI and CHIRP are keen to open discussion with the PYA about how to address the twin issues of (i) yachting’s negative image with the wider public, following the oligarch debacle early in 2023, and (ii) the environmentalists’ campaign to “ban superyachts”. We look forward to having our colleagues at Italian Yachtmasters (IYM), Hellenic Yachtmasters’ Club (HYMC), and Groupement des equipages professionels du yachting (GEPY) with us during the discussions with the NI and CHIRP. A further factor has very recently made it clear that the ISPS Code has stagnated to the point whereby it is partly the Irrelevant Ship and Port Facility Security Code. Defensive measures such as armed guards and creating an onboard citadel, which were relevant and effective when high seas piracy was a daily threat in some areas, are of reduced usefulness in the present situation in the Red Sea. The Houthi group based in North Yemen has used drones and ballistic missiles to attack 12 ships in the Red Sea and adjacent waters in the past month. Only dedicated defensive equipment on warships can detect and counter such attacks. A targeted commercial vessel would receive little or no warning of such an attack, and anyway would have no defensive capability. There would be no time to shoot, and no time to retire to a citadel. Any realistic defence can only come at inter-governmental level with deployment of military assets. This week, on 18th December the formation of a joint naval task force was announced. In response, on the 19th December the Houthis announced their capacity and intent to deliver attacks every 12 hours against shipping. This is all hot news, but outside of shipping circles the general public is so far not stirred up about rockets being fired at bulk carriers or container ships. To the Houthis, yachts may look like small fry, not worth the expenditure of ammunition. But if the connection were to be made about the propaganda value of the destruction of such a despised symbol of plutocrat wealth as a superyacht, then for an indeterminate period it would be game over for a link between Mediterranean yachting and any place East of Suez. The yachting industry has the resources to deal with its image problem, and to take corrective action in all areas where it is open to valid criticism on environmental grounds (Part 1: SuperyachtNews - Unmanaged risk ; Part 2: Unmanaged risk ). Effective implementation will require a time frame of several years. In the interim, the PYA and its partner groups representing crew interests will be active in formulating guidelines for crew in handling environmental protests, in conjunction with other industry bodies. Regarding the new form of maritime threat affecting the Red Sea, we shall provide regular advisories through our contacts with flag states and involved maritime security companies. It is actually very unlikely that any yacht owners would send their vessel on a Red Sea transit at the moment. Calls to maritime insurers, and reports from on-board security providers, indicate: (i) many yacht owners have cancelled their plans to proceed East of Suez for this winter: (ii) a rise in insurance rates is anticipated for those who wish to make the transit: and (iii) notwithstanding its current news dominance, Houthi terrorism has not supplanted piracy as the major risk to shipping in the Red Sea and adjacent waters, but has piled another serious risk on top. ​ PYA attends Engineering Sub Group Meeting in Southampton with the MCA To All news 29 February 2024 The PYA recently took part in this year’s first Engineering Sub Group meeting at the Warsash Maritime Academy in Southampton, UK to discuss recent developments. The meeting served as a platform for the Maritime and Coastguard Agency (MCA), PYA, and IAMI training providers to exchange information, address current issues, and raise concerns. “We received important feedback from the industry which was discussed during our latest meeting with all parties. The PYA is in regular contact with yacht crew to understand issues affecting certification and training and we want to thank our members for their valuable contributions,” said Kim Llorente, Operations Manager for the PYA. Below are a number of key areas discussed in the latest meeting and the updates we received: Oral Exam Booking System : The MCA acknowledged the challenges faced with booking oral exam dates. They are exploring alternative software solutions which will also prevent unauthorized individuals from booking exams on behalf of others. E-TR(B) Pilot: A pilot program for the E-TR(B) will soon involve 50 cadets. This mobile app will allow for completing tasks with the additional ability to include photos, videos, and other phone-generated information. Video guides will also be available, making the overall TR completion experience smoother. After the pilot, the app will be rolled out to all cadets and eventually to SV Engineers. Watchkeeping Service for CoC: The MCA may consider including watchkeeping service, beyond traditional seagoing service, towards the Certificate of Competency (CoC) requirements. However, comprehensive documentation of onboard activities is crucial in such cases. It is recommended to consistently follow this practice to avoid any complications with sea service verification. AEPC1 Course Update: The working group on the Approved Electric Propulsion Course (AEPC1) has held several meetings, with another one scheduled for early March. While the MCA confirmed that this course will not be mandatory for obtaining a CoC, it might become a requirement for working on vessels utilizing future fuels. SV Alternative Route and Exemptions: The MCA reiterated that IAMI holds the delegated authority to assess exemption requests for MCA exams. The MCA regularly audits IAMI to ensure that this process is conducted with strict adherence to established criteria, ensuring exemption is granted only to individuals with demonstrably relevant knowledge. ​ Think you’re exempt from South African tax due to the 'days out of South Africa' rule? Think again... To All news 4 August 2019 You might have seen the news that South Africans who earn income abroad will be liable for 45% tax on all of their earnings after the ZAR 1 million threshold from March 2020. If you’re a South African yachtie and think you might be exempt from declaring your income because you fall within this exemption bracket, or haven’t bothered registering with the South African Revenue Service (SARS) because you think you don’t meet the residency requirements...think again. According to United Advisers Group, unless you are a resident and registered taxpayer in another country, it’s important that you declare your income to SARS to avoid being liable for tax evasion. ‘South African expatriate workers have relied upon the ‘days out of South Africa’ to negate any tax payable on their remuneration. This will no longer be the case, and no matter the period of time you spend outside of SA, tax will be payable.’ It’s important to know that there are a few exemptions affecting international yacht crew earnings, and you might fall into this bracket, however, your status is heavily scrutinised by SARS and it’s important to consult professional tax advice to ensure you are following the correct process. According to an article recently published by Super Yacht News, ‘Something as simple as the mere position held by the seafarer, or the title on the vessel can affect this. Thus, seafarers need to understand the law and how it applies to their individual circumstances to be able to protect their foreign earned income.’ If you’re unsure about how these new tax laws affect you, we advise you to seek help from a professional tax advisor. © PYA PYA Sea Changes Forum 2023 Highlights To All news 4 October 2023 This year’s Sea Changes Forum at the Monaco Yacht Show was the largest gathering of industry professionals since the annual conference was launched in 2011. Taking place on September 28th, the PYA welcomed a host of international speakers from across the yachting world to discuss important industry issues. Areas including crew hiring, retention, welfare and exploration among others were discussed including new initiatives that have been set up to map the ocean floors - a scientific endeavor that demonstrates how our industry is making a difference to research among other things. With more than 150,000 people directly employed in the yachting industry and a global turnover exceeding 24 billion euros a year, there has never been a more exciting time for yachting with a booming maritime industry that is set to bring economic benefits to many countries. Christophe Bourillion, CEO for the PYA commented: “We want to say another big thank you to all our attending guests, partners and supporters that made this year’s event a big success for everyone involved. We had some great discussions and were introduced to insightful topics that have broadened our perspective about what is happening in the yachting industry today - and what is also to come. Miss Angela Wallace, PYA Director of Interior Training, PYA Welfare Group - who discussed current issues in the industry regarding crew including recruitment and retention. Mr Jo Assael, Republic of Marshall Islands (RMI) Yacht Register, International Registries Inc - who introduced the RMI’s Master (Yachts) Unlimited Tonnage Certificate of Competency (CoC). Mr John Everett Nyberg, Technical Director, IHO - who discussed the IHO’s international mapping project. To All news 9 January 2020 The Seafarers' Charity , the UK charity for those who work at sea, has released its new ten-point manifesto which sets out the charity’s commitment for seafarers’ safety and welfare before, during and after their careers. According to Seafarers UK CEO, Catherine Spencer, ‘This manifesto summarises what we are working on and what we want the maritime industry to consider, putting seafarers at the heart of decision-making.’ The Seafarers' Charity asks that seafarers: Be kept safe and return from their seafaring voyages without experiencing accidents or harm Be supported to train and develop careers working at sea Take care of their families and dependants during long periods away from home Feel less lonely or isolated when working at sea, through maintaining connections with family and dependents ashore, as well as having access to onboard initiatives Access free, high-quality welfare services, which respond to seafarers' and their families’ needs with respect and dignity and engage their views on the design and development of services Access independent advice, information and support via their preferred delivery channels such as face-to-face, telephone, web chat, digital tools, social media or self-help literature Be provided with regular welfare breaks in respect of hours of work, shore leave, length of journey, etc. in order to reduce fatigue and to maintain their health and wellbeing Thrive and have their uniqueness respected within a culturally diverse working environment without fear of bullying or harassment. ​ 10 Tips for Conflict Resolution Onboard To All news 4 September 2020 As we near the end of the Mediterranean season, the pressure of working long hours under demanding conditions might be causing tension or conflict onboard amongst crew membes. This conflict can, in turn, lead to additional stress, tiredness and severed relationships. If you find yourself caught up in a dispute with a fellow crew member, or are struggling with a tense and strained working environment, you can follow our ten tips for conflict resolution onboard. Nip it in the bud, quick: The best step to easing conflict onboard is to confront all crew members involved, as quickly as possible to ensure a solution is reached. Not addressing conflict quickly might allow tensions to rise and worsen the situation further. Listen: Captains or senior crew members need to discuss the conflict with all parties to understand what has happened, when did it happen, why has it happened, how can it be fixed? Come together: all crew need to be brought together to voice their concerns or frustrations in a professional manner. Common ground: Senior members need to encourage those involved to find common ground and agree on workable solutions to all problems. Find a compromise: For the sake of working together, each crew member must be willing to give in a little. Explaining the detrimental effect of conflict onboard should hopefully defuse tensions and push those involved towards concession. Confront negative feelings: Crew might be feeling a range of emotions, including hurt, frustration or anger. These feelings should be discussed and diffused. Leadership: Senior crew members can help ease tensions and defuse conflict by reminding crew of their role onboard and mentoring those crew members who might need extra support or assistance. Teamwork: Remind crew about the importance of teamwork onboard and provide them with tools to improve how they work together. Time out: If possible, allow crew members to take a few minutes of time out each day to improve their ability to manage stress and tension onboard. The bigger picture : Encourage crew to focus on the bigger picture, including why they joined the industry and the areas of their role they enjoy the most. It's always worth reminding crew that simply saying 'sorry' and demonstrating mutual respect for other crew members is vital to a professional and happy work environment.
