This year's PYA Sea Changes Forum took place on 29 September at the International Hydrographic Organisation at the Monaco Yacht Show. It was a fantastic forum with a lot of information shared about Regulations and Qualifications from leading Maritime Policymakers. Summary of the PYA Sea Changes Forum 2022 To All news 20 October 2022 This year's PYA Sea Changes Forum took place on 29 September at the International Hydrographic Organisationat the Monaco Yacht Show. It was a fantastic forum with a lot of information shared about Regulations and Qualifications from leading Maritime Policymakers. Below you will find a short summary of the proceedings along with links to each speaker’s presentation video. PYA Board Member Rod Hatch kicked off the forum discussing the new AV/IT certification currently under development, with input from Rod and from other PYA contributors. Mr. Ajit Jacob, Chief Examiner of the MCA presented the UK Hydrographic Office’s (UKHO) plans for the phased exit of paper charts to be compliant for digital navigation by 2026, and the MCA’s shift toward digital and the modernisation of training, including immersive training tools. The MCA is looking to overhaul its suite of student training and assessment criteria by end of 2023. Updates included the status of the amended STCW regulations, electronic training record book, online oral exams and streamlining pathways in OOW less than 500gt. Mr. Mauro Peresso, Technical Director at Transport Malta focused on the rules, regulations and flexibility of the Malta Commercial Yacht Code and the Passenger Yacht Code. He presented Crew Qualifications accepted on Malta Flagged Vessels and spoke about future trends such as green ships and the reality of the volume required for different types of fuel. Ms. Amelie Delamarre-Chardin and Ms. Ornella Valls, Head & Deputy Head of Marine Environment, Mediterranean Maritime Prefecture spoke about current French regulations (anchoring, light & sound, and the protection of marine mammals) and their enforcement in French Waters. Part of Ms. Valls presentation is cut off due to a technical glitch however Ms. Delamarre-Chardin revisits her points in the Q&A. Captain Luca Triggiani, Founding Member and Director of Training of the Italian YachtMasters spoke of taking action and accountability for managing yachting professionals through advanced training (leadership, behavioral analysis, sustainability practices, etc), networking and coaching. Italian YachtMasters path to a sustainable future is through zero tolerance of easy certification, following environmental regulations and advanced crew training for both practical and professional development. Mr. Richard Falk, RYA Director of Training and Qualifications spoke of the RYA’s efforts to improve digital offerings, focus more on practical learning, streamline yacht inspections, and broadly implement the Personal Watercraft (PWC) Safety Scheme. He touched on the confusion following Brexit and cleared up some misinformation. In addition, he asked to spread the word about the annual Trinity House RYA Yachtmaster Scholarship . Emma Baggett, Director of OM and Chair of the IAMI GUEST Program, focused on crew retention, why crew leave, the impact on the industry and ways we can redress the balance through personal and professional development. Rodney A. Hatch – PYA Director of Deck Training Rod hails from Southampton. His connection to the sea goes back to early memories of the city skyline being dominated by the last generation of the great trans-Atlantic liners, and when the only yachts on the River Hamble were wooden ones, sympathetic neighbours of one of the last wooden hulks from the Royal Navy's Napoleonic wars. After graduating from Sheffield University, and prior to actually running away to sea, he was a Lecturer in Economics and Liberal Studies at South Bank Polytechnic, London. His yachting career and commercial sea time span over fifty years, and he is still active as a Relief Captain. From its shores to its inland hills, Rod embraces the Mediterranean littoral, with special affection for the ancient magic of the Greek islands, the glories of Renaissance Italy, France for the historic ties with England, and every vineyard along the way. Mr John Everett Nyberg, Technical Director of the International Hydrographic Organization (IHO) Has over 25 years of experience working with government and public sector stakeholders to facilitate international cooperation initiatives that ensure the safety, efficiency, and sustainability of marine transportation. Throughout his tenure at the National Oceanic & Atmospheric Administration (NOAA), John has managed international, interagency, and legislative engagements and developed high-performing teams of 100+ employees to produce and distribute thousands of nautical charting products. He was also instrumental in orchestrating transition from a raster product, paper-chart organization to one leading with the electronic navigational chart (ENC) as signature product and increasing production rates during the COVID-19 pandemic. In 2023 John was elected to a 6-year term as a member of the IHO Directing Committee. Mr Ajit Jacob, Chief Examiner for the Maritime and Coastguard Agency Ajit is the Chief Examiner for MCA and has been in the role since 2018. He joined the Maritime and Coastguard Agency in 2013, after spending 17 years in the Merchant Navy. During his career at sea, he served as Officer on Aframax Tankers and VLCC’s and as Chief Officer and Master on Ro-Pax Ferries. He joined MCA as Examiner of Mates and Masters with the Seafarer Training Branch. Thereafter, he joined the Marine Office as a Surveyor, carrying out Surveys, Audits, and Port State Control Inspections on a broad range of vessels. In his current role as Chief Examiner, Ajit is actively involved in the Seafarer training modernisation programme being coordinated by the MCA. Ajit has a Masters in International Commercial Law, is an Associate Fellow of the Nautical Institute, Member of the Institute of Chartered Shipbrokers and Younger Brother of the Trinity House. Mr Richard Falk, Director of Training and Qualifications for the Royal Yachting Association Born in Australia, Richard spent much of his childhood in, on or under the water. He continued with his passion for the sea as he moved into adulthood before finally giving up a successful corporate management career 24 years ago to turn his passion for the sea into a career, becoming a commercial master for both sail and power vessels under 200 gt. He went on to work in various parts of the world and has skippered many of the major international yacht races, including around-the-world events. For the last 12 years, he has had responsibility for the management of the RYA’s Training schemes and publications business globally as the Director of Training and Qualifications. Richard works closely with government, both in the UK and abroad, as well as with other boating governing bodies making sure their qualifications are as widely recognised abroad as possible. Mr John Wyborn, Co-founder and Director of Bluewater A yacht brokerage, charter and management company and a provider of crew training and placement services to a large proportion of the yacht crew population. He is President of MYBA (the worldwide yachting association), is on the board of the Professional Yachting Association (PYA) and is a board member of the International Association of Maritime Institutions (IAMI). He is Chairman of IAMI’s influential Small Ship subgroup. John also sits on the board of both the Merchant Navy Training Board and the Maritime Skills Alliance. He joined the Royal Navy as a seaman officer after university and served on various types of vessels including frigates, destroyers, and finally in command of HMS Mentor; a navigation and seamanship training vessel teaching RN trainees and foreign navies. Miss Angela Wallace, PYA Director of Interior Training and Head of the PYA Welfare Group An online VLE training course for Pursers onboard Super Yachts. The Purser program is fully accredited under IAMI & GUEST, and Angie was instrumental in helping create the learning objectives and outcomes for this as well as serving on IAMI GUEST Hospitality Workgroups. Early 2022 Angie took over from Lynne Edwards as the PYA Director of Interior Training and has been volunteering as head of the PYA Welfare Group since then. Her passion is not only for training present and aspiring Pursers but also for supporting and ensuring crew welfare across the board. Mr Jo Assael, Yachts Commercial Director of the Marshall Islands Yacht Register (International Registries Inc.) Jo Assael joined the London office of IRI in 2023 as Yachts Commercial Director. Prior to joining IRI, Mr. Assael spent more than five years in yacht management at Döhle Yachts transitioning from Technical Director to Commercial Director responsible for managing the company’s growth. From 2013-2018 Jo worked for the Cayman Islands Shipping Registry as their Yacht Code Specialist and was heavily involved in drafting the Red Ensign Group’s Yacht Code while also conducting newbuild and in-service yacht surveys, inspections, and audits. He previously served as a surveyor for the United Kingdom’s (UK’s) Maritime and Coastguard Agency (MCA) and served as a lead technical specialist representing the UK MCA at the International Maritime Organization (IMO). Before his time at the UK MCA, Mr Assael was a large yacht naval architect, working on projects ranging in size from 60 to 120m. Mr. Assael serves as Chairman of the Technical Committee of the International Superyacht Society. He is a Chartered Engineer (CENG) with the Engineering Council and a member of the Royal Institute of Naval Architects (RINA). Mr. Assael has a degree in Naval Architecture from Solent University. The yachting industry has always been very discreet, largely unknown to the general public. The seizing of yachts of Russian oligarchs has placed our industry on the front page of mainstream media, from CNN to the FT, opening it up to public scrutiny. Yachting and Public Opinion - Rough Seas Ahead? To All news 6 October 2022 The yachting industry has always been very discreet, largely unknown to the general public. The seizing of yachts of Russian oligarchs has placed our industry on the front page of mainstream media, from CNN to the FT, opening it up to public scrutiny. Since then, a number of initiatives have recently been launched which will impact the way we operate: In 2023, the Maritime industry will be included in the EU Emissions Trading Scheme. Yachts are - for the time being - excluded. However, powerful environmental NGOs are lobbying the European Commission to include yachting in the new scheme. In July 2022, a private initiative to track the routes of superyachts and calculate their greenhouse gas emissions was launched. It is drawing much interest and public support (this follows a similar initiative tracking private jets owned by Elon Musk , other businessmen and artists). On 24thSeptember 2022, climate activists blocked a quayside in Port Vauban (Antibes) - one of the most popular superyacht marinas in the Mediterranean, to protest against what they deem to be ultra-rich ‘climate criminals'. The above projects/actions are firmly establishing Yachting in the "court of public opinion". Collectively, we cannot ignore these issues and requests for public accountability. Become Research Partner The PYA launched a groundbreaking study to explore the impact of sexual harassment on yachting crew across the industry. The survey was conducted with PYA members and provided an insight into prevalent wellbeing issues that have been affecting a number of yacht crew professionals over the past several years. Sexual harassment has been one of the difficult subjects to tackle in the industry where there have been diverging standards and practices on how to address it. There are misconceptions on what constitutes as sexual harassment, what the procedures are and many yacht crew are unaware of their rights - or how they can seek help. Explore some of the key takeaway findings from our Sexual Harassment in Yachting 2018 study below. (Research partners can request access to full statistics by contacting their PYA representative. Exploring the impact of sexual harassment in the yachting industry A number of fielding questions was asked to respondents to learn more about their current yachting experience and the types of yachts they had been working on: How long have you worked on board a yacht? 44% of respondents said they had worked on board a yacht for less than 1 year. 39% of respondents said they had worked on board a yacht for 1-5 years. 11% of respondents said they had worked on board a yacht for 6-10 years. 5% of respondents said they had worked on board a yacht for 10-20 years. 1% of respondents said they had worked on board a yacht for 20+ years. What is the length of the yacht? 12% of respondents said they had worked on board a yacht that was less than 30m in length. 46% of respondents said they had worked on board a yacht that was between 30 to 50m in length. 26% of respondents said they had worked on board a yacht that was between 50 to 75m in length. 13% of respondents said they had worked on board a yacht that was between 75m to 100m in length. 2% of respondents said they had worked on board a yacht that was between 100m to 125m in length. Less than 1% of respondents said they had worked on board a yacht that was in excess of 125m in length. Respondents were then asked a series of questions relating to sexual harassment and complaint procedures in the yachting industry. (Some questions have been redacted. Please contact us if you wish to access the full data which includes over 30 questions and responses): Were you given a copy of the yacht's Complaint Procedure when you joined? 51% of respondents said they had been given a copy of the yacht's Complaint Procedure when joining. 49% of respondents said they had not been given a copy of the yacht's Complaint Procedure when joining. Does the yacht have a written policy regarding sexual harassment? 34% of respondents said the yacht had a written policy regarding sexual harassment. 36% of respondents said the yacht didn’t have a policy regarding sexual harassment. 30% of respondents said they were unsure whether the yacht had a policy regarding sexual harassment. Unfortunately, far too many yacht crew are still finding themselves in the situation of being treated unfairly or aren't paid after leaving a vessel and aren't quite sure what their rights are. What to do when things go wrong... To All news 26 August 2019 Have you found yourself in dispute between your current or old employers after being fired or voluntarily leaving? Unfortunately, far too many yacht crew are still finding themselves in the situation of being treated unfairly or aren't paid after leaving a vessel and aren't quite sure what their rights are. Long standing PYA Director and Captain, Richard Le Quesne, who has been providing guidance to our members on what to look out for in their work contract and what to do in the instance of being fired, has given the following advice: Terms of your contract... If you're working on a commercial or charter yacht, you should have been given, before you joined the vessel, a contract, now known as a Seafarers Employment Agreement (SEA) which conforms to the Maritime Labour Convention 2006 (MLC 2006), which is an international convention regulating the employment of seafarers. This convention has created the benchmark for private ‘pleasure' vessels and meant many crew are now being employed under SEA-type contracts, even though this still doesn’t provide the same legal protection and employment terms as MLC 2006. Because crew on private vessels aren’t required to be contracted under this convention, their employment terms are usually governed by the national laws of the Flag States. Far too many crew are still finding themselves in situations where their contract doesn’t meet any of these standards, or they’re given no contract at all – especially if they're hired for a temporary period. Here are some steps you can take if you find yourself in one of the following situations: If you leave voluntarily... In most cases, notice of one month is required but longer notice periods are sometimes used for senior crew. Always give notice in writing, even if you have first done so verbally. Regardless of the contractual notice period, it’s desirable to give as much notice as possible so as to make the task of finding your replacement easier for the Captain and so increase the chances of getting a good reference. Do not, except under the most extreme circumstances, quit without giving notice. Not only does this put you in breach of contract and so possibly liable for expenses incurred in replacing you but it will be a blot on your record and may make finding a job harder in the future. When the time comes to leave the yacht, you may be asked to sign a document setting out the financial details (salary owed, accrued holiday pay, etc.) of your departure. If you are, insist on being given a signed copy. Also, remember to ask the Captain or the Mate to make an entry in your Discharge Book and to give you a Certificate of Discharge – in the form of a Sea Service Testimonial, ideally on the PYA’s template, as this covers all required information. They can refuse to give you a reference but they must give you a Certificate of Discharge if you ask for it. If you are fired... In reality, there is no job protection in yachting and anyone can be fired at any time, without reason. Your SEA or Crew Agreement will have a list of serious faults that can lead to instant dismissal but it’s very unusual, in yachting, for these to be invoked. Much more common is for the Captain to tell you that you are to be fired for some other reason – but he does not have to specify it. Commercial yachts and larger pleasure vessels will have a set disciplinary procedure with a series of formal warnings before you are dismissed. If fired, you should insist on being provided with transport back to the agreed repatriation destination and are entitled to ask to be paid in full on the day you leave, but, if you have confidence in the Captain, you can, instead, accept a written undertaking that you will be paid a stated amount by a stated date. As mentioned above, ask for your Discharge Book to be completed and for a signed Sea Service Testimonial /Certificate of Discharge. Once off the yacht, don’t bad-mouth the owner, the yacht or the crew because it makes you look unprofessional and could rebound on you in the future. If you have a complaint... On commercial yachts you should have been given a copy of the complaints procedure when you joined. Many pleasure vessels, especially the larger ones, also have a formal complaints procedure. On a commercial vessel, if you are not satisfied with the outcome of your formal complaint, you have the right under MLC 2006 to take it to the shoreside management and, ultimately, to a Port State Control inspector or a Flag State representative. On a pleasure vessel you may have the right to take your complaint to shoreside management. What your contract should include As stated above, crew on commercial yachts are supposed to have been given, before they joined the vessel, an MLC 2006 compliant Seafarer’s Employment Agreement . This SEA must include the following: The seafarer’s name, date of birth and place of birth The name and address of the ship owner (or employer) Date and place of signing the SEA The seafarer’s job on board Details of the seafarer’s pay including, if relevant, how it’s calculated. The seafarer’s entitlement to paid holidays Termination arrangements. Note: The notice period for the employer cannot be shorter than the notice period for the seafarer. Health and social security benefits to be provided by the employer Repatriation details Reference to the Collective Bargaining Agreement, if any Any other particulars required by the law of the Flag State Important inclusions in the Convention Reg. 1.4 – A seafarer must not be made to pay in any way for obtaining a job. Reg. 2.2 – Wages must be paid, in full, at least every month. Reg. 2.3 – Hours of work / Hours of rest must comply with international rules and must be recorded. Reg. 2.4 – In general, all seafarers must be given at least 2.5 days of paid holiday per month worked. Reg. 2.5 – In most circumstances, a seafarer leaving a ship must be given free transport back to his/her home. Reg. 4.1 – In most circumstances, a seafarer must be provided with free medical care. Reg. 5.1.5 – There must be an established on-board complaints procedure and every seafarer must be given a copy of it when joining. Reg. 5.2.2 – Seafarers have the right to make a complaint to a shore official and this official must follow set procedures in dealing with it.
