This year’s Sea Changes Forum is being held at the International Hydrographic Organisation’s HQ with the conference beginning this afternoon at 3.30pm local time. Guests that have booked their tickets will be able to attend and will be provided with access passes on the ground to proceed to the event. Rodney A. Hatch – PYA Director of Deck Training Rod hails from Southampton. His connection to the sea goes back to early memories of the city skyline being dominated by the last generation of the great trans-Atlantic liners, and when the only yachts on the River Hamble were wooden ones, sympathetic neighbours of one of the last wooden hulks from the Royal Navy's Napoleonic wars. After graduating from Sheffield University, and prior to actually running away to sea, he was a Lecturer in Economics and Liberal Studies at South Bank Polytechnic, London. His yachting career and commercial sea time span over fifty years, and he is still active as a Relief Captain. From its shores to its inland hills, Rod embraces the Mediterranean littoral, with special affection for the ancient magic of the Greek islands, the glories of Renaissance Italy, France for the historic ties with England, and every vineyard along the way. Mr John Everett Nyberg, Technical Director of the International Hydrographic Organization (IHO) Has over 25 years of experience working with government and public sector stakeholders to facilitate international cooperation initiatives that ensure the safety, efficiency, and sustainability of marine transportation. Throughout his tenure at the National Oceanic & Atmospheric Administration (NOAA), John has managed international, interagency, and legislative engagements and developed high-performing teams of 100+ employees to produce and distribute thousands of nautical charting products. He was also instrumental in orchestrating transition from a raster product, paper-chart organization to one leading with the electronic navigational chart (ENC) as signature product and increasing production rates during the COVID-19 pandemic. In 2023 John was elected to a 6-year term as a member of the IHO Directing Committee. Mr Ajit Jacob, Chief Examiner for the Maritime and Coastguard Agency Ajit is the Chief Examiner for MCA and has been in the role since 2018. He joined the Maritime and Coastguard Agency in 2013, after spending 17 years in the Merchant Navy. During his career at sea, he served as Officer on Aframax Tankers and VLCC’s and as Chief Officer and Master on Ro-Pax Ferries. He joined MCA as Examiner of Mates and Masters with the Seafarer Training Branch. Thereafter, he joined the Marine Office as a Surveyor, carrying out Surveys, Audits, and Port State Control Inspections on a broad range of vessels. In his current role as Chief Examiner, Ajit is actively involved in the Seafarer training modernisation programme being coordinated by the MCA. Ajit has a Masters in International Commercial Law, is an Associate Fellow of the Nautical Institute, Member of the Institute of Chartered Shipbrokers and Younger Brother of the Trinity House. Mr Richard Falk, Director of Training and Qualifications for the Royal Yachting Association Born in Australia, Richard spent much of his childhood in, on or under the water. He continued with his passion for the sea as he moved into adulthood before finally giving up a successful corporate management career 24 years ago to turn his passion for the sea into a career, becoming a commercial master for both sail and power vessels under 200 gt. He went on to work in various parts of the world and has skippered many of the major international yacht races, including around-the-world events. For the last 12 years, he has had responsibility for the management of the RYA’s Training schemes and publications business globally as the Director of Training and Qualifications. Richard works closely with government, both in the UK and abroad, as well as with other boating governing bodies making sure their qualifications are as widely recognised abroad as possible. Mr John Wyborn, Co-founder and Director of Bluewater A yacht brokerage, charter and management company and a provider of crew training and placement services to a large proportion of the yacht crew population. He is President of MYBA (the worldwide yachting association), is on the board of the Professional Yachting Association (PYA) and is a board member of the International Association of Maritime Institutions (IAMI). He is Chairman of IAMI’s influential Small Ship subgroup. John also sits on the board of both the Merchant Navy Training Board and the Maritime Skills Alliance. He joined the Royal Navy as a seaman officer after university and served on various types of vessels including frigates, destroyers, and finally in command of HMS Mentor; a navigation and seamanship training vessel teaching RN trainees and foreign navies. Miss Angela Wallace, PYA Director of Interior Training and Head of the PYA Welfare Group An online VLE training course for Pursers onboard Super Yachts. The Purser program is fully accredited under IAMI & GUEST, and Angie was instrumental in helping create the learning objectives and outcomes for this as well as serving on IAMI GUEST Hospitality Workgroups. Early 2022 Angie took over from Lynne Edwards as the PYA Director of Interior Training and has been volunteering as head of the PYA Welfare Group since then. Mr Jo Assael, Yachts Commercial Director of the Marshall Islands Yacht Register (International Registries Inc.) Jo Assael joined the London office of IRI in 2023 as Yachts Commercial Director. Prior to joining IRI, Mr. Assael spent more than five years in yacht management at Döhle Yachts transitioning from Technical Director to Commercial Director responsible for managing the company’s growth. From 2013-2018 Jo worked for the Cayman Islands Shipping Registry as their Yacht Code Specialist and was heavily involved in drafting the Red Ensign Group’s Yacht Code while also conducting newbuild and in-service yacht surveys, inspections, and audits. He previously served as a surveyor for the United Kingdom’s (UK’s) Maritime and Coastguard Agency (MCA) and served as a lead technical specialist representing the UK MCA at the International Maritime Organization (IMO). Before his time at the UK MCA, Mr Assael was a large yacht naval architect, working on projects ranging in size from 60 to 120m. Mr. Assael serves as Chairman of the Technical Committee of the International Superyacht Society. He is a Chartered Engineer (CENG) with the Engineering Council and a member of the Royal Institute of Naval Architects (RINA). Mr. Assael has a degree in Naval Architecture from Solent University.     Overcoming the hazards of the yachting industry Overcoming the hazards of the yachting industry To All news 7 February 2020 The Times recently published an article about the lives of crew in the superyacht industry, highlighting that although crew enjoy large salaries, exotic destinations and long breaks in between seasons, they’re paying a heavy price to live up to the industry’s relentless demands with depression, sexual harassment and burnout being all too common. The article which was clearly written to shock and leans towards sensationalism, in places, does manage to highlight some of the harsh realities that many crew, unfortunately, still face. It also labels the industry as one of the few places where the super-rich still ‘get what they want without being subject to a single authority’. Whilst, this may make for good reading, it’s not entirely accurate and fails to capture the fact that the vast majority of crew, including both men and women, have been able to build happy and successful careers in the industry, despite its perceived reputation. Below, we provide some further explanation on some of the key points raised in this article and provide solutions to those crew suffering from burnout or sexual harassment. Is the industry ‘above all authorities’? No. Although the article states that crew working on private vessels are essentially working on ‘billionaires’ own personal floating kingdoms’, it’s important to understand that all vessels are subject to the laws of the countries in which they are registered. On top of this, many vessels are regulated by the International Labour Convention (ILO) which enforces the Maritime Labour Convention (MLC) 2006. The use of an MLC-compliant employment contract is becoming more and more commonplace - even on private vessels - and is pushing the industry into an era where private vessels are being required to offer MLC compliant contracts in order to attract and retain more experienced and valuable crew. Whilst it is not easy for a seafarer to trigger legal proceedings if he/she has been wronged whilst working onboard, it’s worth noting that there are several organisations , including the PYA, which are dedicated to the welfare of yacht crew and can provide assistance to crew who need help. The PYA regularly attends meetings with regulatory bodies which create and enforce the standards to which the industry is regulated, so as a crew member, it’s important to align yourself with an organisation which is aware of the regulations and can help advise you in the event that something goes wrong. Are there any options for crew who have experienced sexual harassment or assault? Whilst The Times reported that crew who have experienced sexual harassment feel helpless, they failed to mention that those who are working under the terms of MLC 2006 are entitled to protection from sexual harassment and have the right to decent conditions of work. For full details of the Maritime Labour Convention and how to make a complaint, visit the Seafarers’ Rights International website . If you are being harassed, REPORT IT, either to your HOD, captain or management company. It’s important to document all incidents and keep the evidence for possible future reference. If you’ve reported the incident but nothing has been done, there are a number of organisations which can help provide advice and support. The PYA is available to direct all members who are victims of sexual harassment to an appropriate support service. What to do if you’re experiencing burnout or mental health issues Whilst the Maritime Labour Convention (MLC) 2006 requires that crew must not work for more than 14 hours out of every 24, it is widely recognised that some yachts do not comply, claiming that it is necessary to exceed these limits in order to provide the level of service expected by owners and guests. One solution for crew is to track their hours using time-tracking apps like Workrest , which helps track each crew member’s hours of work and shows if they comply with MLC and ILO regulations. Crew suffering from burn-out or other mental issues shouldn’t hesitate to contact organisations such as the PYA and ISWAN which can put them in touch with experienced professionals who can provide help.   • French Anchorage Regulations

    France has introduced anchorage regulations (enforced in March 2021) which prevent yachts over 24m (78ft) from anchoring within areas containing protected Posidonia seagrass beds. Last update: 12/06/2024 Posidonia - sometimes referred to as the lung of the ocean - plays a vital role in the production of oxygen and purification of our ocean. Unfortunately, Posidonia is incredibly fragile and anchoring in the Posidonia seabed can cause significant destruction which could take up to one thousand years to restore. The maritime authorities recognise the positive economic impact of the yachting industry on the Mediterranean coasts, as well as the efforts of yachting professionals to protect the environment. They will, therefore, encourage the creation of organised buoy fields and moorings with public as well as private funding. These facilities will be under the responsibility of land-based authorities and local communities. Key facts Anchorage regulations are applicable to yachts over 24m (78ft); Infringement of the new regulations could result in fines of up to €150,000 and also possible banishment of the vessel from French waters. The Captain is ultimately responsible; All restricted zones are clearly indicated within the maps (below), which are a part of the new decrees issued by the Maritime Prefecture; The maritime authorities are attempting to speed up the update of the new charts published by SHOM; It is also understood that messages regarding the anchoring rules will be broadcast through CROSSMED, in both French and in English; All restricted areas will be displayed on the Donia app; In case of adverse weather, the authorities have confirmed that safety and security will take precedence. Vessels that may take shelter in forbidden zones (Posidonia meadows) but may be required to provide justification for their decision; The authorities have indicated that, in future regulation, they will adopt a limitation of mooring time to 72 hours. This will not apply to yachts in routine operation, with crew on board, but rather to vessels left without supervision and presenting a risk of stranding. To enable this management of mooring times, the Maritime Prefecture has agreed to establish a list of yachts (24-45m) benefiting from an implicit renewal every 72 hours, for the whole season. Infringement Unlike the Spanish or Italian authorities, France elected to sanction the position of the vessel itself. This can lead to serious consequences as yachts in breach of these regulations can be fined up to 150,000€ and receive a possible ban from French waters, whereas the environmental infraction is ''only" a hundred euros. In addition, several of the means to be used to establish potential offenses, such as human observation from aircraft, boats or land-based platforms can lead to arbitrary decisions. All sémaphore's conversations are recorded and, just in case, it could be relevant for the captain to record the conversation as well. A list of all semaphores , with their area coverage, telephone numbers and email addresses are provided on Annex 1, page 9 of the regulation. The following information is also provided in this regulation: Annex II and III (pages 10, 11): Information to provide to the sémaphore when seeking anchoring or Dynamic Positioning authorisation. The MCA releases new advice on conversions of Engineer Yacht COCs To All news 8 August 2023 The MCA have updated their advice regarding conversions from foreign Engineering licenses to MCA SV CoCs. Among some of the criteria include the successful completion of MCA approved modules including technical safety course certificates and the MCA oral examination required for the specific conversion being requested. The MCA’s latest guidance covers conversions for 8 different scenarios with steps to take to begin the request. In order to make a successful conversion, you must hold a CoC from a country that the UK accepts towards the issuance of a UK FSE/CEC. You are however not required to obtain a FSE or CEC to apply for a conversion in the first instance. To learn more about the new guidance on conversions see the latest publication from the MCA. The consultation for the Approved Electric propulsion course (AEPC), covering batteries, electronics on electric and hybrid vessels, appropriate first actions in case of failure, etc., has been approved. A draft Merchant Shipping Notice (MSN) on the modernization of the Master 500 Restricted CoC transferability to other sectors is available for consultation. The MCA also announced that they are creating a pathway to a Master Yacht Unlimited size , removing the 3000 GT limitation. Developments will be followed closely by the PYA because it is of particular interest to long term career Deck Officers. Finally, in consultation with the PYA, they are going to simplify sea service definitions and requirements, with the use of the E-TRB and Simulator time. 16:42 Julian Smith, Principal Surveyor - Cayman Islands Ship Registry  - shared insights on the recently updated REG Yacht Code . Significant changes will be summarized and promulgated in a further PYA advisory.   16:57 Gerard Griffiths, Professional in maritime safety and training, delivering STCW courses, Seascope France   - who highlighted how lithium-ion fires can easily be triggered on board and the importance of knowing how to deal with batteries and avoid potential issues through training.   17:02 Mark Savona,   Safety Coordinator, Technical Department, Transport Malta (TM) - who presented the origin of the different Maltese Codes. What the advantages are under the Maltese Flag. What certification is currently available for crew under the Maltese scheme.   17:17 Pierre-Luc Lecompte,   Senior Maritime Affairs Administrator,   Division of “State Action at Sea”, Head of the Marine Protection and Sustainable Development Unit, French Maritime Administration (Préfet Maritime de la Méditerranée) - who discussed the origin and issues that the Administration faces regarding the implementation of certain restrictions in the South of France, including the Posidonia and speed limitations in certain areas.   17:32 Richard Falk FRIN,   Director of Training and Qualifications, Royal Yachting Association (RYA) (By video Link)  – gave an update on the Superyacht Personal Watercraft Safety Scheme that continues to grow, with around 450 yachts now using this scheme to ensure their guests are well equipped to use their onboard PWC’s safely and confidently. Port State authorities are not formally obliged to accept these certificates for use in their waters, but to date, they are unaware of any which do not, other than on rare occasions where anti-social behaviour has been demonstrated by the operators of the craft. The RYA Yachtmaster celebrated its 50th anniversary last year, which also saw the 100,000th RYA Yachtmaster Certificate of Competence issued, a fitting milestone for such a special year. The RYA continues the evolution from traditional navigation towards more emphasis on the electronic navigational tools available across all manner of craft. “Digital First”, is the name given to the strategy that supports the push from hydrographic offices around the world to move (eventually) away from paper charts.   17:42 Gregory Romano,  Managing Director, Romano Energy - introduced how their biofuel is produced and how it can easily replace traditional fuel to diminish a yacht’s carbon footprint.   • The Flag State and the Seafarer

    The flag states are essentially the ‘nationality’ of the yacht. For example, if it is registered in the Isle of Man, the yacht will be governed by the laws of the Isle of Man, so it’s a relatively important decision for the owner to make, not to mention the fiscal implications of the country that they choose. The Flag State and the Seafarer To All news 20 June 2022 For those of you that have been in yachting for a while, you’ll know all about the flag states. But for those that need an introduction, this is essentially the ‘nationality’ of the yacht. For example, if it is registered in the Isle of Man, the yacht will be governed by the laws of the Isle of Man, so as you can imagine, it’s a relatively important decision for the owner to make, not to mention the fiscal implications of the country that they choose. The flag state holds a lot of power because they can govern the legislature and regulations that are likely to influence the yacht and international maritime issues. As early as the Roman Greek empire, flag states have played a role, often being selected for protection and benefits for that specific port when it came to trading. Obviously, these days, the more important issues such as regulations, tax and general standards dictate how flag states are chosen. What were once known as “open registers”, which back in the day were chosen for their trading advantages, are now known as “flags of convenience” which are generally laxer with their regulations, standards and often have sanctions to trade in contrabands and dangerous goods. Additional points that attract ship owners to these registries is the ability to hire crew of any nationality, freedom from tax & fiscal control and the mere simplicity of the registration procedure. However, what’s in the interest of the owner, is not necessarily in the interest of the seafarer. Fortunately, the majority of yachts tend to register with the red ensign group, which are a group of British Shipping Registries which are well known for their high standards and strict adherence to rules and regulations that provide safe work environments for seafarers as well as the protection of the marine environment. SOLAS, the IMO, MARPOL, the STCW and other conventions also contribute to these objectives. The red ensign group, along with any registries of the Paris White List, are registries under which you would be wanting to work. The Paris MoU Annual Report gives an extensive list of registries ranked in order from quality to poor performance flags. With your HOD, Captain and DPA all being points of contact for any contentious issues onboard, the flag state is also responsible for seafarers that are working under its jurisdiction and are not to be ruled out when issues onboard arise. As with their responsibility to protect seafarers, so it is the responsibility of the seafarer to report any incidents to the flag state. Failing to do so not only skew any reporting but also has a knock-on effect to potential flaws in registration and protection of seafarers in the long term, so it is important to take this responsibility seriously. Flag states are considered a bit of a weak point when it comes to the protection of seafarers, as they are one of the highest authority figures to go to. There is work being conducted to illuminate ways in which to improve the situation, however, there is very little action that can be taken to ensure flag states are taking every measure possible to oversee the good of the maritime industry. They like to remain diplomatic with other flag states and IMO sanctions have many legal and fiscal effects that make it an unattractive solution. Not to mention the numerous different regulations within the commercial sector that they need to oversee which is time-consuming and requires specific expertise which can be a strain on resources. This brings us back to the point of taking every action as a maritime professional to work together with the authorities towards creating improvements, which includes the reporting of incidents. There are many organisations that can also assist seafarers in need and can facilitate communication in difficult circumstances, namely Nautilus , the PYA , The Seafarers Rights International (SRI) and it’s important to make use of these organisations and the flag states to strive for better conditions in the maritime industry throughout.
