    On the morning of February 24th, Captain Simon Johnson was lining up MY Go in preparation for the 10.30am bridge in St. Maarten. If you’re in the yachting industry, you’ve probably been hiding under the proverbial rock if you don’t know the rest of the story. If you’re in the yachting industry, you’ve probably been hiding under the proverbial rock if you don’t know the rest of the story. Despite the onboard computer systems telling him all was in normal working order, the yacht’s gearbox seized into ahead. His split-second decision to make a controlled impact with the St. Maarten Yacht Club wooden dock averted a far worse disaster with the busy road bridge. Within 20 minutes, video footage of the event had been uploaded to social media and the judgement began to flow. “Asleep at the helm,” said one. “You wouldn’t let this guy Loose in charge of a row boat (sic),” said another on one post which has been viewed 128,000 times. Fortunately, no one was physically hurt in the incident, but in spreading a story before the facts had been established, the reputation Simon had built up in yachting (and Captain roles onboard M/Y Lady Lau and M/Y St David among others in a career spanning 40 years) threatened to collapse unless he retook control of the story. “To be annihilated like that in the industry was extraordinary,” says Simon. “With the Owner’s support, I put a statement on my Facebook page within 12 hours so we could take control of the narrative” he explains. “I explained that this was not an issue of incompetence, but of a major malfunction.” The next day an article in a local newspaper, The Daily Herald, was published after Simon was interviewed by one of its journalists. By presenting the truth, Simon was able to take the scandal out of the story. He also ensured that, when the news was picked up by global media outlets, (as superyacht incidents inevitably do), the facts ran alongside the footage. A high-profile figure in the industry, Simon says his reputation was established enough to ride out the crisis, although he acknowledges, nearly a month on, that he still feels stung “But if it were a 30-year-old Captain in their first command role, they may struggle to come back from this,” he explains. Aware of the link between social media and reputation (he explains he has previously engaged an independent audit of his social media presence), Simon was obviously savvy enough to understand the steps he needed to take, but not everyone in his situation would.     The PYA is very pleased to share with you the good news that the French government has agreed to remove a significant portion of the yachting sector from its Décret Etat d’Accueil legislation, and the famous Cabotage Declaration issue we have been dealing with since the end of last year will no longer apply to commercial yachts that comply with the “70% rule”. The letter recently sent to MYBA by Franck Dosne, Director of the Ports of Nice and Cannes. 201606 Letter from Director of ports of Nice and C (14) .pdf Download PDF • 93KB This law would have obliged Captains of all foreign flagged commercial yachts under 650 GT to complete official forms and supply supporting documentation to the authorities 72 hours prior to the start of any single voyage commencing in French waters. In addition to the usual ship documents and crew list, this legislation would have also required a copy of each crew member's SEA, a copy of each crew member's last pay slip and proof of each crew member's social security contribution. Having been alerted by MYBA to this potential minefield for yachts operating out of French ports, the Chambre de Commerce et d’Industrie leapt into action and the PYA, ECPY, GEPY and IYM quickly joined forces. Together, we lobbied the French government, with the support of MYBA’s French lawyers, Ince & Co. During two round-table meetings with various government bodies and numerous exchanges on the subject, we were able to make the case that the new legislation, in force since 1st November 2015 and applicable to all commercial maritime activity, should not apply to charter yachts whose main activity takes place outside French territorial waters. Congratulations and thanks are due to all those involved in achieving this extremely positive result, with special recognition to Franck Dosne, Director of the Ports of Cannes & Nice. It is testament to the power of joint lobbying that we were able to achieve this very positive result, in a relatively short space of time.   • Training - How to spice up fire drills onboard

    Now that the Covid-19 lockdowns have been eased in Europe and some Caribbean yachting centres, most yachts are focused on returning to some type of “normality”. Whilst some boats might already be cruising, or due to depart in the next few days, others might not see such an immediate return to active yachting.  Training - How to spice up fire drills onboard To All news 25 June 2020 Now that the Covid-19 lockdowns have been eased in Europe and some Caribbean yachting centres, most yachts are focused on returning to some type of “normality”. Whilst some boats might already be cruising, or due to depart in the next few days, others might not see such an immediate return to active yachting. There are two considerations to bear in mind. Globally, we have not seen an instant return to the pre-pandemic world as we knew it. The hospitality industry, of which we are a part, is in parlous straits, and no leading analysts are forecasting a full recovery in less than 18 to 24 months from now. International air travel continues to be restricted. St. Tropez with 50% capacity and social distancing in bars and cafes, with service staff wearing masks and gloves, might not feel like the old St. Tropez. The same dampening of destination ambience will apply all across the Mediterranean. So, we might experience some reduction in out-of-port cruising activity this summer. The other consideration is that the easings are tentative and come with a warning that a secondary spike in infection and mortality rates may mean a return to local or general lockdowns to try to contain the second wave. So some planning is advisable in case we might see more of the same lockdowns in the year ahead. This does not have to be a glum prospect. There is an opportunity here to develop a culture of mentoring on board by encouraging the creative talents among crew members. The same creativity and artistic skills which make theme nights a charter success can be applied to training in disaster preparedness. To illustrate, while basic drills are fundamental to effective emergency responses, embodying some drill aspects into a theatrical scenario that could actually happen adds a new level of teamwork. For example, fire drills tend to be repetitive and do not recreate the experience of the mandatory fire fighting courses. But a surprise themed drill can go a long way towards sharpening the edge of responders. How to run a surprise themed fire drill One tried and proven example is for the captain to conspire with the chief engineer to set up a realistic morning fire drill for the crew. Here are the simple steps: Captain and Engineer on standby to isolate and shut off power to all lighting, including emergency lighting, in the crew area. In the early morning darkness before their normal wake-up times, block all exits except for the emergency exit with chairs and set up strobe lights wrapped in red rags. On a couple of laptops have YouTube running with clips of burning buildings. Load up the toaster, burn the toast, call the chief on the radio to shut off power, and retire to a dark corner as the fire alarm sounds. As half-asleep and half-dressed figures emerge and smell burning, yell “Move! Move! Get out!”. The unreal lighting is disorientating. Is it real or a drill, but the captain is urging them to get out fast. Observe. Who are the quick thinkers? Who leads the way out? Who thinks to check all the cabins for anybody left behind? When everybody reaches the assembly point the exercise is over. Later in the morning, conduct a debriefing to bring up lessons learned, and suggestions about ways to improve future fire drills. For a change it will be the crew, not the captain, doing all the talking. Endless variations can be played on this theme. By giving crew (single or in pairs) the opportunity to create, write and direct any type of scenario which can be worked into routine drill schedules, it will help get further buy-in from them. They will become more capable and confident in their safety roles and will start to develop their own leadership skills. This example is intended to stimulate crew to produce their own scenarios so as to maintain a high level of interest and involvement in safety drills. We will follow up next week with some ideas on preparing engaging first aid drills and preparing for annual audits/surveys, including specific chart exercises. Rodney A. YARE 2024: Captains Brainstorm Solutions for Finding the Right People To All news 3 April 2024 The recent Yachting Aftersales and Refit Experience (YARE) event in Italy brought captains, yacht managers and other stakeholders, together for a lively discussion on a critical topic: The Human Capital – Finding the Right People . The session, hosted by CEO Christophe Bourillon and Operations Manager Kim Llorente from the Professional Yachting Association (PYA), tackled challenges faced by captains who are increasingly responsible for managing complex crew needs, but may not have all the necessary resources. The 90-minute session proved to be an excellent discussion that brought up not only issues that seem to be more and more recurring among captains, but also some innovative ideas and solutions. Here are the key takeaways: Standardization is Needed: Captains are calling for a more standardized approach to everything from crew recruitment and training to crew and yacht management. This would help streamline processes and ensure a higher level of professionalism across the industry. Captains Need More Support: The role of captains has grown significantly, and they often lack the proper training and tools to manage crew effectively. The industry needs to invest in education (for both crew and owners), workshops and training on self-development and mental health, and clearer communication to manage expectations. The PYA will build on the YARE discussions and initiate some of these ideas starting from the participants in the room and sharing the projects with anyone in the industry who wishes to be involved and be part of the change.
