    ​ Know your EU Social Security Rights and Obligations To All news 1 March 2022 Within the EU, Seafarers, like other EU Nationals are entitled to social protection. Those crew (who are EU nationals) working on board vessels flying the flag of an EU country, by virtue of Article 11.4 of EU Regulation 883/2004, shall be subject to be insured in the Flag State. The only exception for crew to be insured in the Member State where the employer has their business/registered office, is if he/she has their residency in the same Member State. It is important to know that, although there are various private schemes offered to yachts that, along with insurance policies, claim to provide private alternatives to a state social security scheme, none of these private solutions are approved by country bodies, such as ENIM in France. There are also significant legal consequences, both civil and criminal for yachts not complying with social security obligations. France In July 2017, France introduced a social security decree, following mandatory obligations under the MLC, requiring all seafarers resident in France, or those who spend more than 181 days in France, to pay into their social security system. The aim of these regulations is to ensure seafarers resident in France are afforded protection (whether the yacht is a pleasure or commercial vessel). During the 2021 Cannes Yachting Festival, PYA Partner, Breaking The Mould Accounting, heard from local lawyers that there are still yacht owners regularly being prosecuted for hidden employment, despite the legislation being in place for 5 years. Malta With exception to the above ruling, yacht crew working on vessels registered in Malta have the benefit of registering their social security in another EU member state scheme, allowing greater flexibility to those who reside elsewhere and still receive the same social protection.     ​ 10 Tips for Conflict Resolution Onboard To All news 4 September 2020 As we near the end of the Mediterranean season, the pressure of working long hours under demanding conditions might be causing tension or conflict onboard amongst crew membes. This conflict can, in turn, lead to additional stress, tiredness and severed relationships. If you find yourself caught up in a dispute with a fellow crew member, or are struggling with a tense and strained working environment, you can follow our ten tips for conflict resolution onboard. Nip it in the bud, quick: The best step to easing conflict onboard is to confront all crew members involved, as quickly as possible to ensure a solution is reached. Not addressing conflict quickly might allow tensions to rise and worsen the situation further. Listen: Captains or senior crew members need to discuss the conflict with all parties to understand what has happened, when did it happen, why has it happened, how can it be fixed? Come together: all crew need to be brought together to voice their concerns or frustrations in a professional manner. Common ground: Senior members need to encourage those involved to find common ground and agree on workable solutions to all problems. Find a compromise: For the sake of working together, each crew member must be willing to give in a little. Explaining the detrimental effect of conflict onboard should hopefully defuse tensions and push those involved towards concession. Confront negative feelings: Crew might be feeling a range of emotions, including hurt, frustration or anger. These feelings should be discussed and diffused. Leadership: Senior crew members can help ease tensions and defuse conflict by reminding crew of their role onboard and mentoring those crew members who might need extra support or assistance. Teamwork: Remind crew about the importance of teamwork onboard and provide them with tools to improve how they work together. Time out: If possible, allow crew members to take a few minutes of time out each day to improve their ability to manage stress and tension onboard. The bigger picture : Encourage crew to focus on the bigger picture, including why they joined the industry and the areas of their role they enjoy the most. It's always worth reminding crew that simply saying 'sorry' and demonstrating mutual respect for other crew members is vital to a professional and happy work environment.   • PYA Sea Changes Forum 2023 Highlights

    © PYA PYA Sea Changes Forum 2023 Highlights To All news 4 October 2023 This year’s Sea Changes Forum at the Monaco Yacht Show was the largest gathering of industry professionals since the annual conference was launched in 2011. Taking place on September 28th, the PYA welcomed a host of international speakers from across the yachting world to discuss important industry issues. Areas including crew hiring, retention, welfare and exploration among others were discussed including new initiatives that have been set up to map the ocean floors - a scientific endeavor that demonstrates how our industry is making a difference to research among other things. With more than 150,000 people directly employed in the yachting industry and a global turnover exceeding 24 billion euros a year, there has never been a more exciting time for yachting with a booming maritime industry that is set to bring economic benefits to many countries. Christophe Bourillion, CEO for the PYA commented: “We want to say another big thank you to all our attending guests, partners and supporters that made this year’s event a big success for everyone involved. We had some great discussions and were introduced to insightful topics that have broadened our perspective about what is happening in the yachting industry today - and what is also to come. It is our hope that this year’s Sea Changes Forum can be the melting pot that helps our industry stay informed while advancing technological innovations. We hope to see you all again next year!” As part of this year’s Sea Changes Forum, the PYA welcomed the following guest speakers: Mr John Wyborn, IAMI Board member - who discussed the work IAMI does for yacht training including the Deck Certification Report. Miss Joey Meen, IAMI Guest Program Director - who shared insights on the importance of soft skill training & the CPD opportunities of bespoke (non-mandatory) education to support yachting careers – with the Yacht Owners Representative Program being provided as an example. Mr Richard Falk, Director of Training and Qualifications, Royal Yachting Association - who introduced “RYA Training and Qualifications, Rising to the Challenges of the Future”. Miss Angela Wallace, PYA Director of Interior Training, PYA Welfare Group - who discussed current issues in the industry regarding crew including recruitment and retention. Mr Jo Assael, Republic of Marshall Islands (RMI) Yacht Register, International Registries Inc - who introduced the RMI’s Master (Yachts) Unlimited Tonnage Certificate of Competency (CoC). Mr John Everett Nyberg, Technical Director, IHO - who discussed the IHO’s international mapping project. Guests in attendance included captains and seafarers from across the industry including representatives from various organisations in yachting. Following the forum, we took part in a cocktail gathering on the roof of the IHO HQ at the Monaco Yacht Show.     ​ Think you’re exempt from South African tax due to the 'days out of South Africa' rule? Think again... To All news 4 August 2019 You might have seen the news that South Africans who earn income abroad will be liable for 45% tax on all of their earnings after the ZAR 1 million threshold from March 2020. If you’re a South African yachtie and think you might be exempt from declaring your income because you fall within this exemption bracket, or haven’t bothered registering with the South African Revenue Service (SARS) because you think you don’t meet the residency requirements...think again. According to United Advisers Group, unless you are a resident and registered taxpayer in another country, it’s important that you declare your income to SARS to avoid being liable for tax evasion. ‘South African expatriate workers have relied upon the ‘days out of South Africa’ to negate any tax payable on their remuneration. This will no longer be the case, and no matter the period of time you spend outside of SA, tax will be payable.’ It’s important to know that there are a few exemptions affecting international yacht crew earnings, and you might fall into this bracket, however, your status is heavily scrutinised by SARS and it’s important to consult professional tax advice to ensure you are following the correct process. According to an article recently published by Super Yacht News, ‘Something as simple as the mere position held by the seafarer, or the title on the vessel can affect this. Thus, seafarers need to understand the law and how it applies to their individual circumstances to be able to protect their foreign earned income.’ If you’re unsure about how these new tax laws affect you, we advise you to seek help from a professional tax advisor.   • The Flag State and the Seafarer

    ​ The Flag State and the Seafarer To All news 20 June 2022 For those of you that have been in yachting for a while, you’ll know all about the flag states. But for those that need an introduction, this is essentially the ‘nationality’ of the yacht. For example, if it is registered in the Isle of Man, the yacht will be governed by the laws of the Isle of Man, so as you can imagine, it’s a relatively important decision for the owner to make, not to mention the fiscal implications of the country that they choose. The flag state holds a lot of power because they can govern the legislature and regulations that are likely to influence the yacht and international maritime issues. As early as the Roman Greek empire, flag states have played a role, often being selected for protection and benefits for that specific port when it came to trading. Obviously, these days, the more important issues such as regulations, tax and general standards dictate how flag states are chosen. What were once known as “open registers”, which back in the day were chosen for their trading advantages, are now known as “flags of convenience” which are generally laxer with their regulations, standards and often have sanctions to trade in contrabands and dangerous goods. Additional points that attract ship owners to these registries is the ability to hire crew of any nationality, freedom from tax & fiscal control and the mere simplicity of the registration procedure. However, what’s in the interest of the owner, is not necessarily in the interest of the seafarer. Fortunately, the majority of yachts tend to register with the red ensign group, which are a group of British Shipping Registries which are well known for their high standards and strict adherence to rules and regulations that provide safe work environments for seafarers as well as the protection of the marine environment. SOLAS, the IMO, MARPOL, the STCW and other conventions also contribute to these objectives. The red ensign group, along with any registries of the Paris White List, are registries under which you would be wanting to work. The Paris MoU Annual Report gives an extensive list of registries ranked in order from quality to poor performance flags. With your HOD, Captain and DPA all being points of contact for any contentious issues onboard, the flag state is also responsible for seafarers that are working under its jurisdiction and are not to be ruled out when issues onboard arise. As with their responsibility to protect seafarers, so it is the responsibility of the seafarer to report any incidents to the flag state. Failing to do so not only skew any reporting but also has a knock-on effect to potential flaws in registration and protection of seafarers in the long term, so it is important to take this responsibility seriously. Flag states are considered a bit of a weak point when it comes to the protection of seafarers, as they are one of the highest authority figures to go to. There is work being conducted to illuminate ways in which to improve the situation, however, there is very little action that can be taken to ensure flag states are taking every measure possible to oversee the good of the maritime industry. They like to remain diplomatic with other flag states and IMO sanctions have many legal and fiscal effects that make it an unattractive solution. Not to mention the numerous different regulations within the commercial sector that they need to oversee which is time-consuming and requires specific expertise which can be a strain on resources. This brings us back to the point of taking every action as a maritime professional to work together with the authorities towards creating improvements, which includes the reporting of incidents. There are many organisations that can also assist seafarers in need and can facilitate communication in difficult circumstances, namely Nautilus , the PYA , The Seafarers Rights International (SRI) and it’s important to make use of these organisations and the flag states to strive for better conditions in the maritime industry throughout.     ​ Hill Robinson and Sanlorenzo Academy seek yachts to take students To All news 24 March 2021 We are seeking yachts in the Ligurian Region (due to travel restrictions) who can take our students on and provide an opportunity for Deck/Interior role experience under the relevant Head of Department during normal crew working hours. Note that yachts are not expected to pay the students – this is part of an Internship Placement which will assist them in attaining necessary hours towards graduation from the Sanlorenzo Crew Academy. Students are between the ages of 24-35yrs, have their own accommodation, are trained across all areas of working on-board, plus have all necessary qualifications. While the Academy benefits greatly from your kind assistance, we also hope to benefit your current crew and yacht should you be willing to take on an extra hand (or two!) in preparation for the coming season.
