  • Representation

Acting on behalf of yacht crew to ensure your opinions are heard The PYA has been the voice of international yacht crew since its inception in 1991. The PYA consults with policy makers who write legislation affecting the construction, operation and manning of large yachts. Over the years, PYA has participated in numerous workgroups and steering committees to ensure the point of view of those actually working on board is known and understood. As the yachting industry continues to grow, compulsory training requirements have been introduced so as to fall in line with other maritime sectors. These increased regulations serve an internationally-agreed purpose to increase safety and awareness, so unfortunately they're not going to go away! However the role of the PYA is to elbow out (when possible) or ameliorate training that is not relevant to yachting. For 30 years, the PYA has sat on the MCA Yacht Qualifying Panel as the representative of yacht crew. This annual meeting is attended by all the major yacht training providers worldwide, to discuss current yacht training issues, course syllabus, exam results and new exam procedures and new courses under MCA & STCW amendments. This is the annual chance to put the opinions of yacht crew on the table for discussion on these subjects. With the increased size of vessels in yachting, a few years ago the PYA fought and won to have “yacht service” recognized within the commercial sectors. With that came the “glass ceiling” project, where the MCA made clear that, whenever possible, they intended to ensure anything new introduced was “transferable training” so that our crew could more easily cross over to the commercial qualifications. The PYA works with other administrations to fight for the interests of yacht crew. Whilst we don't win every battle, we have triumphed in many areas over the years and have avoided legislation being put in place which would negatively affect the yachting industry and those working in it. You can read more about some of our successes here . The PYA has helped many members with issues such as non-payment of wages, unfair dismissal, lack of contracts etc. The power that the voice of the PYA has means that we are far better positioned to assist crew when things go wrong than if they tried to represent themselves. The people fighting these battles for you are all volunteers giving up huge amounts of their time to protect your futures in yachting. Whether you know it or not, you need the PYA! • Safer Waves offers crew sexual harassment support

Safer Waves offers crew sexual harassment support To All news 6 July 2021 PYA Councillor, Lynne Edwards, recently wrote an article highlighting the prevalence of sexual harassment in the yachting industry, which included some of the findings from our survey on sexual harassment, conducted in 2018. Since then, multiple yachting organisations developed services to offer crew more support in this area, including Safer Waves - an organisation set up in 2019 offering support services for seafarers who have experienced sexual assault, sexual harassment or gender discrimination on board. Safer Waves is a UK registered charity and has recently introduced their anonymous email support service, run by a team of volunteers who have received training from Rape Crisis South London in how to respond to emails about sexual violence, providing emotional support and information. What to do if you’ve been a victim of sexual harassment? Crew should always report instances of sexual harassment or assault to their HOD’s or Captain onboard. If no action has been taken, we advise crew to report all incidents to their management company and organisations such as the PYA or ISWAN who can provide confidential assistance and put you in touch with legal professionals and counseling services, such as Safer Waves. For more information about Safer Waves, click here . To read Lynne Edwards' article via OnboardOnline, click here. • French regulations regarding anchorage and Posidonia – Updated

French regulations regarding anchorage and Posidonia – Updated To All news 1 April 2021 After two years of discussions, the main orders prohibiting mooring in the French protected areas of the Mediterranean have been published. This means that yachts will have to anchor further from the shore and beaches. The three main yachting associations: PYA, ECPY and GEPY met recently with the services of the Maritime Prefecture, to discuss the new regulation and its implementation. The maritime authorities The maritime authorities recognise, the positive economic impact of the yachting industry on the Mediterranean coasts, as well as the efforts of yachting professionals to protect the environment. The three associations raised concerns regarding the complexity of the new rules and the need to implement clear information campaigns about the implementation of the rules (up-to-date charts, etc.). Key facts The maritime authorities will encourage the creation of organized buoy fields and moorings, with public as well as private funding. These facilities will be under the responsibility of land-based authorities and local communities. In case of adverse weather, the authorities have confirmed that safety and security will take precedence. Vessels that may take shelter in forbidden zones (Posidonia meadows) may be required to provide justification for their decision. The maritime authorities are attempting to speed up the update of the new charts published by SHOM. It is also understood that messages regarding the anchoring rules will be broadcasted through CROSSMED, both in French and in English. It is understood that the restricted areas will also be displayed on the Donia application. There are areas such as the beach of Pampelonne in Saint Tropez/Ramatuelle where the regulations are not yet clarified. The authorities have indicated that, in future regulation, they will adopt a limitation of mooring time to 72 hours. This will not apply to yachts in routine operation, with crew on board, but rather to vessels left without supervision and presenting a risk of stranding. To enable this management of mooring times, the Maritime Prefecture has agreed to establish a list of yachts (24-45m) benefiting from an implicit renewal every 72 hours, for the whole season. Unlike the Spanish or Italian authorities, France elected to sanction the position of the vessel itself. This can lead to serious consequences as the maritime infraction can amount to 150,000€, whereas the environmental infraction is "only" a hundred euros. In addition, several of the means to be used to establish potential offences, such as human observation from aircrafts, boats or land-based platforms can lead to arbitrary decisions. PYA, ECPY and GEPY will continue to work closely with the maritime authorities (Préfecture maritime de Méditerranée), to propose a joint Préfecture maritime / Yachting professionals observatory to monitor incidents during the season.
